Terms of Service
These Terms of Service (the "Terms") govern your use of BotMother: the Telegram bot @BotMamamBot, the website botmamam.com, the dashboard at dashboard.botmamam.com, and every bot created, connected, cloned, or hosted through them (together, the "Service"). The Service is operated by BotMother ("BotMother", "we", "us"). By using the Service you agree to these Terms. They apply to every bot on the Service, including bots created, connected, or hosted before this version of the Terms was published: keeping a bot running on the Service is acceptance. If you do not agree, delete your bots and stop using the Service.
In short
- These Terms apply to every bot on BotMother, including bots built before they were published. Keeping a bot running here is acceptance.
- BotMother is a tool and a host. Every bot is created and operated by the person who requested it, and that person is fully responsible for what it does, what it stores, and whether it is legal.
- Our automated checks are a safety net, not an approval. Getting past them is a breach, and we may stop or permanently delete any bot, its data, and any account at any time, with or without notice and without refund.
- Our servers are in the European Union. Everything your bot collects is stored there. Laws that require your users' data to stay in their own country, or that restrict passport and ID data, are your responsibility, and passport or ID data may not be collected through bots at all.
- Data held for your bots is stored on your behalf, as is. We do not guarantee it, back it up for you, or accept responsibility for it. Keep your own copies.
- Payments are made in Telegram Stars through Telegram and are final, except where these Terms or the law say otherwise.
- The Service is provided as is, without warranty, and our liability is limited as far as the law allows.
This summary is for convenience only. The full English text below is what applies.
1.What BotMother is
BotMother is a tool. You describe a Telegram bot in plain language; our software, with the help of third-party AI models, generates code for it; and we host and run that code on our servers under a bot token that belongs to your own Telegram account.
We provide the tooling and the hosting. We do not design, review, approve, edit, endorse, or operate your bots. Each bot is created, configured, and operated by the person who requested it (the "Creator"), and the Creator is its publisher and operator toward everyone who uses it.
BotMother acts only as a technical intermediary and hosting provider for content and services that Creators make. We do not monitor bots, their content, or their data, and we have no obligation to do so. Nothing in the Service is a statement by us about any bot.
2.Eligibility and your account
- You must be at least 18 years old and legally able to enter into a binding contract.
- Your BotMother account is your Telegram account. You are responsible for everything done through it.
- You must also comply with Telegram's Terms of Service, Telegram's Bot Developer Terms, and Telegram's terms for Stars. Where those are stricter than these Terms, they apply as well.
3.Your bots are yours, and your responsibility
You are solely responsible for every bot you create, connect, clone, or host through the Service, including:
- what it does, says, sells, collects, and sends;
- its legality in every country where it is offered or used, and its compliance with the rules of every platform it touches;
- the content and data it processes, and the rights, notices, and consents needed to process them;
- the accuracy of any claim it makes and any transaction it takes;
- how it treats its users, including their privacy and anything they are owed under law.
Code generated for your bot is generated on your instructions. It may contain errors, security weaknesses, or behavior you did not intend. You must test and understand your bot before giving it to others. We are not a party to any relationship between you and your bot's users, and we owe them nothing under these Terms.
4.Acceptable use
You may not use the Service, or build or run any bot, to:
- break any law or regulation, or help anyone else do so;
- harass, threaten, stalk, defame, or deceive anyone;
- collect, expose, look up, or trade in other people's personal data without a lawful basis, including any deanonymization, "lookup", or doxxing tool;
- generate, file, or coordinate false or abusive reports or complaints against people, accounts, or groups on any platform;
- send spam or unsolicited messages, or artificially manipulate any platform's metrics;
- distribute malware or phishing, or run fraud, scams, pyramid or multi-level schemes, or unlicensed financial services;
- offer illegal gambling, illegal drugs, weapons, counterfeit goods, or sexual content that exploits anyone (content involving minors will be reported to the authorities);
- infringe anyone's intellectual property or other rights;
- collect or store passport or other identity document data (numbers, scans, or photos), payment card numbers, health, biometric, or other sensitive personal data, or knowingly collect data from children, through a bot;
- probe, overload, or interfere with the Service or with other users' bots, or evade any limit or quota;
- circumvent, disable, or trick our automated checks, or use the Service after we have suspended or terminated you.
This list is illustrative, not exhaustive. We decide, at our sole discretion, whether something violates this section.
5.Automated checks are not approval
We run automated checks on bot requests and on some bot behavior. They are a best-effort safety measure, not a review, an audit, or an approval. They can miss things, they can be bypassed, and they can be wrong in either direction.
The fact that a request or a bot passed our checks, or that a bot has been running for a long time, never means that we reviewed it, approved it, or accepted responsibility for it. Getting past our checks does not make a prohibited bot allowed. It is itself a breach of these Terms.
6.Enforcement: we may suspend or delete at any time
We may, at any time, with or without notice, and at our sole discretion:
- stop, suspend, restrict, or permanently delete any bot, together with its code, configuration, database, files, and history;
- suspend or terminate your account and any or all of your bots;
- decline to build, edit, or host anything;
- report you or your bot to Telegram, to the authorities, or to affected parties, and preserve and share relevant data with them.
We may do this for any reason we consider sufficient, including a suspected breach of these Terms, a legal request, a complaint, a risk to the Service or to others, or exceeding the limits of your plan. No refund or compensation is owed for anything suspended, deleted, or terminated under this section, and we are not liable to you or to anyone else for the consequences, including lost data or lost business.
We have no obligation to monitor bots and no obligation to warn you before acting.
7.Plans and limits
- The Service is offered in plans (Free and paid tiers). Each plan has limits, for example on the number of builds, the size of a bot's audience, or the volume of messages. Current limits are shown in the bot and on botmamam.com, and may change.
- If a bot exceeds the limits of your plan, we may warn you and then suspend that bot until you move to a plan that covers it. A suspended bot keeps its data and audience but stops responding until then. Lifting a limit-based suspension by upgrading is immediate. We are not liable for the period during which a bot was suspended.
- We may change plans, prices, limits, and features at any time. A change to the price of an active subscription takes effect from your next billing period.
- We may discontinue the Service, or any part of it, at any time.
8.Payments
- All payments are made in Telegram Stars through Telegram. Telegram processes the payment; we never receive your card, bank, or wallet details.
- Subscriptions renew automatically every 30 days through Telegram until cancelled. You can cancel at any time in Telegram's settings (Settings, then My Stars). Cancellation stops future renewals, and your plan stays active until the end of the paid period. When you upgrade to a higher plan, the unused part of your current period is credited toward the new one.
- Build passes are one-time purchases. A pass is used up by a successful build; a failed build does not use it. Unused passes do not expire and are not refundable.
- Featured-placement auctions: bids are charged when placed. Winning bids are kept as payment for the placement. Non-winning bids are refunded automatically after the auction closes.
- Except as stated here or required by law, all payments are final and non-refundable, including when a bot or an account is suspended or terminated under these Terms, and when a plan goes unused.
- You are responsible for any taxes that apply to your purchases, and to anything you sell through your bots.
9.Data stored for your bots
Each bot has its own database and file storage on our servers. Everything in it, including any personal data of your bot's users, is stored on your behalf and on your instructions. In relation to that data:
- you are the controller, the party responsible for it, and we are only a hosting provider processing it on your behalf;
- you are responsible for the lawfulness of collecting and using it, for every notice, consent, and rights request owed to your users, and for its accuracy and contents;
- we do not check it, back it up for you, or guarantee it. Storage is provided as is. It may be lost, corrupted, deleted, or disclosed, and to the maximum extent permitted by law we accept no responsibility for it, including for its loss, corruption, exposure, or misuse;
- we may access it to operate the Service, provide support, investigate abuse, or comply with the law;
- we may delete it when a bot is deleted, suspended, or terminated, when your account is closed, when a bot has been inactive for an extended period, or as described in the Enforcement section;
- if you need it kept, keep your own copies. Never rely on the Service as the only copy of any data. Backup features, where offered, are a convenience with no guarantee;
- deletion may be immediate and irreversible. We have no obligation to return, export, or restore any code or data after a bot or account is deleted, suspended, or terminated, and no liability for its loss.
10.Where data is stored, and local laws
Our servers are located in the European Union. Everything the Service stores, including everything your bot collects from its users, is stored there. For most countries that is abroad.
Some countries require certain personal data of their citizens to be stored only on servers inside the country, restrict transferring it abroad, or impose special rules on identity documents, financial data, and other sensitive data. You are solely responsible for knowing and complying with the data protection, data localization, and cross-border transfer laws that apply to you and to your bot's users. If those laws do not allow your bot's data to be stored in the European Union, you must not collect that data through the Service.
By using the Service you confirm that you have the right to store and process your bot's data on our servers in the European Union, and you accept full responsibility, including under the Indemnity section, for any breach of such laws by you or your bot. We give no assurance that the Service is suitable for data that is subject to localization requirements.
11.Your bot's users
Your bot's users are your users, not ours. You are responsible for telling them who operates the bot, what it does with their data, and how to reach you. If a user of your bot contacts us, we may refer them to you and may share your public Telegram handle with them. If we receive a complaint about your bot, we may act under the Enforcement section without consulting you.
12.Transferring a bot to another user
A bot can be handed to another BotMother user with the transfer feature. A transfer moves control on BotMother only: the bot's code licence, settings, database (including all data about its users), message history, dashboard, and billing move to the new owner. It does not change who owns the bot in Telegram (@BotFather); the two parties must arrange that between themselves.
- From the moment a transfer is accepted, the new owner is the Creator of the bot and takes over every responsibility under these Terms: for the bot, its content, its users, and its data, including data collected before the transfer. The previous owner stays responsible for everything that happened while they owned it.
- By transferring a bot, the previous owner confirms that they have the right to hand over the bot and all of its data, including their users' personal data, and takes responsibility for that hand-over toward their users and under the laws that apply to them. By accepting, the new owner accepts these Terms and takes the bot and its data as is.
- Transfers are final. We are not a party to the transfer, we do not verify either party, and we have no responsibility for disputes between them, for a transfer made in error or through a leaked link, or for what either party does before or after it. We may refuse, delay, or reverse a transfer at our discretion.
- After a transfer, the new owner's plan and its limits apply to the bot; a bot that exceeds them may be warned and suspended as described above. Payments made by the previous owner are neither refunded nor transferred.
13.AI-generated content and third-party services
- Bot code, text, and other content are generated by third-party AI models on your instructions. They are provided as is. They may be wrong, insecure, biased, or infringe rights, and you are responsible for reviewing them before use.
- Your requests, and the messages your bots send to AI features, are processed by third-party AI providers. Telegram provides the messaging and the payments. We are not responsible for these providers, their availability, or their output.
14.Third parties and events outside our control
- We are not responsible for anything Telegram or any other third party does, including restricting, suspending, banning, or deleting your bot or your Telegram account, changing their services, prices, or terms, or refusing a payment. Your bot exists on Telegram at Telegram's discretion, not ours.
- We are not liable for any failure or delay caused by events beyond our reasonable control, including outages or changes at Telegram, AI providers, hosting or network providers, attacks on our systems, loss of access to any third-party service, legal orders, or force majeure.
15.Intellectual property
- The Service, including its software, design, prompts, templates, and content, is owned by BotMother and protected by copyright and other laws. These Terms give you no rights in it other than the right to use the Service as described.
- Code, configuration, and other content generated for your bot are produced by the Service and remain the property of BotMother. You receive a limited, non-exclusive, non-transferable, revocable licence to run them on the Service, as your bot, for as long as your account and the bot exist. The Service does not provide generated code for download or for use outside the Service, and you may not copy, extract, or reuse it elsewhere. Your bot's Telegram identity and token belong to your Telegram account.
- Templates and example bots we provide remain ours; you receive a licence to use them within the Service.
- You grant us the right to store, run, copy, and process your bots, requests, and data as needed to operate the Service, and to use anonymised usage information to improve it.
16.Assumption of risk and release
You use the Service, and everything built or hosted with it, at your own risk. To the maximum extent permitted by law, you release BotMother and its operator from all claims, demands, and damages of every kind, known or unknown, arising out of or connected with any bot, any other user, any user of your bot, any AI output, or any third-party service.
17.No warranty
The Service is provided "as is" and "as available", with all faults, and without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, security, or uninterrupted or error-free operation. We do not warrant that any bot will work, keep working, be secure, be lawful, or suit any purpose. Anything we say about the Service is a description, not a promise.
18.Limitation of liability
To the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, business, goodwill, data, or content, however caused;
- we are not liable for anything your bots do or fail to do, for the data they hold, for the acts of their users, or for the acts or omissions of Telegram or of any AI provider;
- our total liability to you for all claims arising out of or relating to the Service in any 12-month period is limited to the amount you paid us in that period, or the equivalent of 100 Telegram Stars if you paid nothing.
Some jurisdictions do not allow certain exclusions or limitations. In those, our liability is limited to the smallest extent the law allows.
19.Indemnity
You will defend, indemnify, and hold harmless BotMother and its operator from any claim, demand, loss, liability, cost, or expense, including legal fees, arising out of or connected to your bots, their content, their users, your data, your use of the Service, or your breach of these Terms or of any law.
20.Termination
You may stop using the Service at any time and delete your bots from the bot's menu. We may suspend or terminate your access at any time as set out in the Enforcement section. The sections on your responsibility, acceptable use, enforcement, payments, data stored for your bots, no warranty, limitation of liability, indemnity, and governing law survive termination.
21.Changes to these Terms
We may change these Terms at any time by posting the new version at botmamam.com/terms and updating the date at the top. Material changes may also be announced in the bot. Continuing to use the Service after a change means you accept it.
22.Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which BotMother's operator is established, without regard to its conflict-of-law rules. Any dispute will be brought before the competent courts of that jurisdiction, unless mandatory law in your country of residence gives you the right to another forum. Before starting any claim, contact us and give us 30 days to resolve it. To the extent permitted by law, any claim must be brought within one year of the event giving rise to it or it is permanently barred, and disputes are resolved on an individual basis only, not as part of any class, collective, or representative action.
23.General
If any part of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a right is not a waiver of it. These Terms, together with the Privacy Policy, are the whole agreement between you and us about the Service. You may not transfer your rights under these Terms; we may transfer ours to a successor operator of the Service. Features may be experimental and may change or be withdrawn at any time. Any feedback or suggestion you give us may be used freely, without obligation to you.
